As a provider of training services this client regularly entered into a tendering process for contracts with large organisations. When successful with a tender they would sometimes be subject to regulations governed by TUPE, the Transfer of Undertakings (Protection of Employment). This involved taking on employees from other organisations that used to deliver the contract prior to it being awarded elsewhere.
Vital HR were asked to support this client who we had initially had contact with to provide employment contracts and handbook. We were involved in discussions prior to transfers to try and agree the numbers and individuals that did transfer were the employees required to deliver the work within the contract and to agree terms of the transfer prior to it happening. In some instances we were able to agree with the organisation that had lost the contract not to transfer anyone at all.
When it was necessary to transfer employees we provided support throughout the consultation process, if required meeting with individuals to address any concerns about the transfer.
Following the transfers we were always at hand to provide guidance on what could or couldn’t be done with regards to the employment relationship. Following one transfer the organisation was affected by the economic downturn and the rising price of fuel and the need to consider redundancies became apparent. Vital HR worked closely with the client to ensure it did not contravene the TUPE regulations and assisted with the redundancy process.
